Description
This document pertains to the procedures of community placement and treatment for those persons adjudicated Not Guilty By Reason of Insanity and committed to the Colorado Department of Human Services under Forensic Community-Based Services. Under the law, persons found insane are not necessarily incompetent to stand trail. Where incompetence abates the criminal action and is procedural in effect, insanity is substantive and renders the defendant not guilty. Once psychiatric symptoms have been stabilized and s/he is no longer considered a danger, eligible persons may be considered for placement in the community.
